Explaining Louisiana’s proposed constitutional amendment for 2024

NEW ORLEANS — In your Ballot Box Breakdown: this November, Louisiana voters will be asked to decide on one Constitutional Amendment, which is Act 408.

The question on your ballot will read:

Do you support an amendment to require that federal revenues received by the state generated from Outer Continental Shelf alternative or renewable energy production be deposited into the Coastal Protection and Restoration Fund?

The current constitution dictates that when Louisiana gets federal revenue from oil and gas production on the coast, the state treasurer must deposit that money into the Coastal Protection and Restoration Fund.

Act 408 adds text to also include funds from renewable energy; like wind, solar, tidal, wave, and geothermal.

The Coastal Protection and Restoration Authority is a huge part of stabilizing coastal erosion, performing flood mitigation projects, creating marshes, restoring barrier islands, and much more.

The CPRA 2025 Master Plan says that recurring federal funds from offshore oil and gas are paid out every spring based on revenue made the prior fiscal year. 

A vote ‘yes’ would allow federal revenue from oil and gas - plus renewable energy - to go toward the Coastal Protection and Restoration Fund.

A ‘no’ vote keeps things as they are, where only oil and gas revenue is deposited.

Remember early voting begins October 18th. Election Day is Tuesday, November 5th.
