BATON ROUGE, La. — More than a week after a Westwego man died following a bar fight in Baton Rouge, police documents are bringing more information to light, according to WBRZ.
BRPD arrested Matthew Marsiglia, 21, Wednesday for manslaughter. His arrest affidavit details what happened that night and shows that the victim likely threw the first punch.
In reports obtained by our partners at WBRZ, police recounted surveillance video they say shows two groups of men talking. The victim, Devin Repath, 26, is then seen punching another man before the two groups are separated.
A short time later Repath is seen exchanging words with Marsiglia and another man. In the parking lot, police say Repath is seen trying to hit Marsiglia, who ducks and then shoves Repath. At that point, he is knocked to the ground and hits his head on the ground.
Marsiglia was booked into the East Baton Rouge Parish Prison, officials say he is an LSU student.
According to our partners at WBRZ, Repath and his friends went to an LSU Baseball game Friday night and then went to Fred’s bar for a concert.

"During the conversation Devin Repath walks behind several of his friends and punches [REDACTED] in the head. [REDACTED] then falls to the ground at which time [REDACTED] charges Repath. [REDACTED] is subdued by Repath's friends, and the groups are separated," the affidavit says.
"A short time later [REDACTED] can be seen walking around with [REDACTED] and Matthew Marsiglia. Repath is then seen backing out of the bar while exchanging words with [redacted by police] and Marsiglia," the affidavit says.
"Repath backs up into the parking lot and about halfway into the parking (sic) Repath stops and attempts to hit Marsiglia. Marsiglia ducks and is not hit. Repath then backs up several steps and Marsiglia then takes both hands and shoves Repath by the shoulders causing Repath to fall and strike his head on the parking lot pavement," the affidavit says.
