NEW ORLEANS — The resentencing for Cardell Hayes was continued on Monday morning until July 22 as members of the victim’s family were unable to be in court and give statements if needed.
The judge decided those family members had a right to be in court, so the judge granted a motion for continuance filed by prosecutors.
The defense attorney argued against allowing the continuance.
In April, the 36-year-old Hayes received a 25-year prison sentence for fatally shooting former New Orleans Saints star Will Smith during a confrontation following a car crash in 2016.
Hayes was convicted of manslaughter by a unanimous jury in January, despite his defense team's arguments that he had fired in self-defense, thinking that a drunken and belligerent Smith had retrieved a gun from his SUV.
